Intake and conflict review
A firm may gather enough information to determine whether it can consider the matter, identify possible conflicts, and decide whether representation will be offered.
Investigation and claim development
The work may include collecting records, identifying responsible parties and available insurance, assessing losses, and preserving evidence. The order depends on the facts.
Negotiation or lawsuit
Some matters involve a claim and negotiation; others proceed to a lawsuit. In a civil lawsuit, pleadings, discovery, motions, settlement efforts, and trial are possible stages, but not every matter reaches each stage.
Resolution and accounting
Before a distribution, ask for a written accounting of the gross recovery, fees, expenses, repayment claims, and net amount. Questions about liens or benefit recovery may need to be resolved first.
